The terms covering The High Street Digital's website, management and AI services.

1. About The High Street Digital
These Terms & Conditions apply to services provided by The High Street Digital, a UK web design and digital services business based in Chester, operating as an unincorporated business. By placing an order, accepting a proposal, subscribing to a service or instructing us to carry out work, you agree to these terms.
Where you have a specific order, proposal, subscription or checkout confirmation from us, the terms of that order also form part of our agreement with you. If there is any conflict, the specific order terms take priority for that service.
2. Website design and development services
We design and build websites to the scope agreed in your proposal or order. Work begins once the scope, price and any initial payment have been agreed. Timings depend on the agreed scope and on you supplying content, feedback and approvals in good time.
3. Website management and maintenance
Where you subscribe to a website management or maintenance service, we provide the ongoing updates, support and care described in your plan. Management services are provided on a recurring basis as set out in your subscription.
4. AI Receptionist services
We offer an AI Receptionist service that answers calls for your business using an AI-assisted system configured with information you supply or approve. The availability, features and pricing of this service are as described on our website at the time you order. Where the service is shown as "launching soon", it is not yet generally available for purchase, and any trial or early access will be governed by the specific terms provided at sign-up.
5. Future AI and automation services
We may introduce additional AI or automation services over time. Those services will be covered by these terms together with any service-specific terms presented when you order them.
6. Client responsibilities
You agree to:
- Provide accurate information and the content, materials and approvals we reasonably need to do the work.
- Ensure you have the right to use any text, images, logos or other material you supply to us.
- Review deliverables and tell us promptly about anything that needs changing.
- Keep your account and login details secure.
- Use our services lawfully and not for anything misleading, harmful or infringing.
7. Project scope and changes
Each project or service has an agreed scope. Requests that fall outside that scope — for example extra pages, new features or significant design changes — may affect the price and timescale, and we'll agree any changes with you before doing the extra work.
8. Content supplied by clients
You are responsible for the accuracy and legality of the content you supply, including text, images, pricing and business claims. You confirm that supplying it to us and our use of it in your project doesn't infringe anyone else's rights.
9. Intellectual property and ownership
Once we've received full payment for a project, the final website deliverables we created for you are yours to use for your business. We retain ownership of our underlying tools, templates, frameworks and know-how, and we may reuse general techniques and non-confidential ideas. You retain ownership of your own content and branding.
10. Third-party software and services
Websites and services often rely on third-party software and providers — for example hosting platforms, content management systems, analytics, payment processors, fonts and plugins. These are governed by their own terms, and we can't be responsible for changes, faults or discontinuation on the part of third-party providers.
11. Hosting and technical dependencies
Where hosting or technical infrastructure is included in your service, it is provided through third-party platforms. We manage these on your behalf as described in your plan, but availability ultimately depends on those providers.
12. AI Receptionist limitations
The AI Receptionist is an AI-assisted system, not a human employee. While it is designed to answer calls helpfully using the information you provide and approve, it may occasionally misunderstand a caller, give an imperfect response or be unable to handle an unusual situation. It does not guarantee that any call will result in a sale, booking or lead conversion.
13. Your responsibility to review important outputs
You are responsible for reviewing important information produced with the help of our services — including AI Receptionist responses, bookings, quotations and messages — before relying on them for business decisions. If something looks wrong, tell us and we'll help correct it.
14. Payment terms
Prices and payment schedules are set out in your proposal, order or subscription. Project work typically requires an initial payment before work begins, with the balance due on completion as agreed. Invoices are payable by the due date stated on them.
15. Recurring subscriptions
Subscription services (such as website management or the AI Receptionist, where available) are billed on a recurring basis as described at checkout or in your order. The billing amount, frequency and included usage are those shown in your subscription.
16. Free trials
Where a free trial is offered for a service, the length and conditions of the trial are those shown at sign-up. Unless you cancel before the trial ends, the paid subscription will begin at the price stated at checkout.
17. Cancellation
You can cancel a recurring subscription in line with the cancellation terms shown at checkout or in your order. Cancellation takes effect at the end of the current paid period unless your specific terms say otherwise. For project work, if you cancel after work has started, payment is due for the work completed up to that point.
18. Suspension for non-payment or misuse
We may suspend a service if payment is overdue or if the service is being misused (for example for unlawful, abusive or fraudulent purposes). We'll normally contact you first to give you the chance to resolve the issue.
19. Termination
Either of us may end an ongoing service in line with its cancellation terms. We may end a service immediately where there is serious misuse or a serious breach of these terms. On termination, amounts already due remain payable.
20. Refunds
Because our services involve time, configuration and work tailored to your business, refunds are considered case by case in line with your statutory rights and the specific terms of your order. Nothing in these terms affects your legal rights as a consumer where they apply.
21. Service availability
We work to keep our services reliable, but we don't promise uninterrupted availability. Services may occasionally be unavailable because of maintenance, technical issues or third-party provider problems.
22. Maintenance and changes
We may update, improve or change services over time — for example to add features, keep software secure or reflect changes from third-party providers. Where a change would materially reduce a service you're paying for, we'll let you know.
23. Acceptable use
You must not use our services to:
- Break the law or encourage unlawful activity.
- Send spam, deceive people or make misleading claims.
- Infringe intellectual property or privacy rights.
- Attempt to disrupt, probe or gain unauthorised access to systems.
24. Liability limitations
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including for death or personal injury caused by negligence or for fraud. Otherwise, to the extent the law allows, we are not liable for indirect or consequential losses (such as loss of profit, revenue or business opportunities), and our total liability in connection with a service is limited to the amounts you've paid us for that service in the 12 months before the claim arose.
25. Confidentiality
We'll keep your confidential business information confidential and use it only to provide your services, and we ask you to do the same for our confidential information. This doesn't apply to information that is public or that must be disclosed by law.
26. Data protection and privacy
We handle personal information in line with our Privacy Policy. Where we process personal data on your behalf as part of a service (for example caller information handled by your AI Receptionist), you remain responsible for having the right to use that data and for your own privacy obligations.
27. Third-party links and services
Our website and deliverables may link to or integrate with third-party websites and services. We're not responsible for their content, terms or practices.
28. Changes to these terms
We may update these terms from time to time. The current version will always be on this page with an updated "Last updated" date. For ongoing subscriptions, we'll give reasonable notice of material changes.
29. Governing law and jurisdiction
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any disputes, unless your consumer rights provide otherwise.
